Legal basis for processing personal data (why I process the data)

Scope of Data Processing

  • - Your identification data (name, surname, contact information, account number and other transactional information)
  • - Other personal data that you provide to us or that we obtain from third parties in the course of providing legal services

I process personal data manually, but in some cases also automatically (newsletter, internal filing system).

Purpose of processing (why I do it)

  •    - Provision of legal services in accordance with the contract concluded with the client
  •    - sending newsletter
  •    - protection of my legitimate interests or those of third parties (for example, my clients if you are a counterparty)
  •    - processing requests sent online (requests for information or deletion, CVs sent in case you want to work with me, etc.)
  •    - compliance with statutory duties

Recipients of personal data (to whom I may give the data)

  •    - Public authorities (e.g. courts, administrative authorities)
  •    - IT service providers (I use email and other Microsoft services)
  •    - other recipients according to your needs and instructions

Duration of processing of personal data (how long I will keep and use the data)

The personal data will be processed for the duration of the provision of the services. After the end of the cooperation, they will be handled in accordance with the applicable legislation, in particular Act No. 85/1996 Coll. (Act on Advocacy), Act No. 499/2004 Coll. (Act on Archiving and File Service and on Amendments to Certain Acts) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).

Client rights (what you can ask for)

The right of access to personal data means that you have the right to obtain information from me about whether I am processing your personal data and, if so, what the data is and how it is processed. You also have the right to have inaccurate personal data concerning you corrected or completed by me without undue delay at your request.

You also have the right to erasure. I must delete personal data I process about you if certain conditions are met and you request it. This right is limited if I process personal data by law (e.g. I must not delete invoices, I must keep a lawyer's file, etc.).

You have the right to ask me to restrict the processing of your personal data in certain cases. You have the right to object at any time to processing that is based on the legitimate interests of the controller (me), a third party or is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

You have the right to withdraw your consent to the processing of your personal data at any time. This only applies if I am processing your data on the basis of consent (for sending you a newsletter), not if I am processing on the basis of a contract (where we would have to terminate the contract).

If you are dissatisfied with the processing of your personal data, you can complain directly to me or contact the Data Protection Authority.

If you give me your consent to the processing of your personal data for the purpose of sending you the newsletter, this consent is voluntary and you can withdraw your consent at any time by writing to me at my address and/or via the link provided in the relevant email message. Consent is granted until revoked.

Out-of-court settlement of consumer disputes

On 5 February 2016, the Czech Bar Association was authorised by the Ministry of Industry and Trade of the Czech Republic to resolve consumer disputes out of court in the area of disputes between attorneys and consumers arising from contracts for the provision of legal services (based on Act No. 634/1992 Coll., on Consumer Protection, as amended).
